A Mt. Orab man accused of sexually touching a 7 year old child was sentenced to spend the next three years in prison on Thursday, March 31.
Gary York, age 64 of the Fivemile community along US-68, pleaded guilty earlier in March to one count of third-degree felony gross sexual imposition for an incident occurring on Jan. 17, 2016. York allegedly engaged in sexual contact with a 7-year-old child on that date.
Indicted in January on charges of gross sexual imposition and importuning, York was suspected of continuous inappropriate contact with the victim throughout that month, according to the indictment.
On Thursday, March 31, Brown County Common Pleas Court judge Scott T. Gusweiler handed York a three year prison sentence with 5 years of post-release control. York was also ordered to receive sex offender treatment and report to the Sex Offender Registry as a Tier II sex offender.
As a Tier II sex offender, York will be required to report his address to the registry every 180 days for 25 years.
Gusweiler also credited York with 74 days for jail time already served.
York was arrested Jan. 17 and held on $35,000 cash or surety bond following a 911 call to Brown County Communications Center about York’s alleged inappropriate conduct with the child.
Andrew Baughey of Brown County Children Services and members of the Brown County Sheriff’s Office investigated the case.
