A Mt. Orab man convicted of attempting to rape a 12 year old child was sentenced Thursday, April 14 to spend the next five years in prison and register as a sex offender for the rest of his life.
Adam D. Spears, age 30 of Mt. Orab, accepted a plea on Thursday admitting guilt to an amended charge of second-degree felony attempted rape. Spears originally was charged with first-degree felony rape and third-degree felony gross sexual imposition for an alleged incident occurring in Sept. 2014.
Following the plea, Brown County Common Pleas Court judge Scott Gusweiler sentenced Spears to spend the next five years in prison, with credit of 144 days for jail time already served, and a mandatory five years of post-release control.
Gusweiler further ruled Spears must adhere to the reporting requirements of a Tier III Sex Offender.
Under the Ohio Revised Code, a Tier III Sex Offender designation is the most severe, requiring the offender to report their address to the Sex Offender Registry in-person every 90 days until their death.
Indicted in November of last year, prosecutors alleged Spears raped a 12 year old relative of his between Sept. 20 and Sept. 22, 2014.
According to prosecutors, the victim was examined at Cincinnati Children’s Hospital after the offense was disclosed by the child to the victim’s family.
Spears was allegedly caught in the act by a witness who stopped him from continuing the suspected rape, prosecutors said.
As a result of the plea agreement, Spears, who has no prior criminal history, faced a maximum sentence of eight years in prison.

I think out system is so screwed how did this guy oonly get 5 yrs I mean are you serious this makes me sick why are these drug dealers getting life sentences and the rapists and murders are getting less time I thinks he should have the same thing done to him that he did to the kid I think it’s time for us citizens to stand up and correct out justice system because this is so backwards

I want to know why are system is so messed up you go out and rape a child get five years you go out and rob a home get ten how messed up our system is… Things come and go but the memories are always there…

I do not understand what is wrong with the system the system basically tells people it’s okay to do what you do by raping someone because they don’t give them no time and some prisons protect the people who rape people I was given 8 years for breaking into a home messed up on Xanax and don’t remember none of it and stealing 42 Xanax and $14 that was sitting on the table but yet this individual gets 5 years for trying to rape somebody that is so messed up are judicial system is a joke because they are basically saying in a roundabout way I’ll just slap you on hand don’t do that again but it’s proven by psychologists that individuals who have a tendency and her sexual preference is that if someone ever younger age it will always be their preference so sad I tell you so sad
